 For Deputies’ Mistakes

Actions by Marion County Sheriff’s officers resulted in more than 60 thousand in damages regarding a house that was damaged and a traffic crash.

  County commissioners were informed by the legal depart­ment that 15 thousand had been approved for the homeowners.

Earlier this year the sheriff’s office had to pay more than 30 thousand dollars to repair the damage. Overall the payment was at least 45 thousand dollars.

     The married couple, Norman and Huong Sweet resided on the west side of the county.

     They hired a lawyer to sue the Marion County Sheriffs Office and they demand a money settlement.

The suit alleged a group of deputies surrounded the house and ordered the surrender of a fugitive from the law who reportedly was not there.

According to the complaint the deputies sought access to the house, telling the two they were seeking a fugitive from justice.  What followed was a five hour standoff, the complaint says.

     The two said deputies used gas and shock grenades in their effort look inside the house.

     In the process the house was "generally destroyed," the lawsuit said.

     The incident reportedly occurred more than two years ago.

Two complaints were on record, one for more than 30 thousand dollars and a later complement of 15 thousand dollars.

The legal department also reported an 18 thousand dollar settlement resulting from an accident. A deputy's car struck a vehicle owned by the other driver who was identified as Mike Dauncan.

The accident occurred in north Marion County.

When the treated effluent was being discharged into the Silver Springs Shores sewer system, lift station #17 overflowed and a sewage backup occurred in the residence of Janet L Bunting located at 306 Emerald Court Place. The sewage backup caused extensive damages.

At our request, Parker Adjusting appraised the damages to Ms. Bunting's residence and arrived at a repair cost in the amount of $11,397.93. Our third party claims administrator, United Self-Insured Services, has reviewed the appraisal report and advised it to be in order.

FISCAL IMPACT: $11,397.93 to be paid from the self-insured fund.

RECOMMENDED ACTION: Approve the settlement.

Michael Duncan vs. Marion County Sheriffs Office Date of Accident: 1/11/01

DESCRIPTION/BACKGROUND: On January 11,2001, Deputy Barry Baskins of the Marion County Sheriffs Office was operating MCSO vehicle #27026 heading West on CR 318. Michael Duncan was driving a 1991 Ford Tempo and had stopped for traffic on CR 318. Deputy Baskin failed to observe Mr. Duncan's vehicle and struck the rear of his vehicle pushing it into the rear of a 1987 Dodge Dakota truck owned and operated by Virgil Parker. Mr. Duncan's vehicle then continued forward and was struck by a tractor/trailor owned by Wheaton Van Lines and operated by James Paiva.

As a result of the accident, Mr. Duncan received serious injuries to his face, leg and shoulder. The County's third party claims administrator, United Self Insurance Services, has negotiated a settlement in the amount of $18,500.00 pending County approval with which defense counsel Ron Slonaker agrees.

FISCAL IMPACT: $18,500.00 to be paid from the self-insured Auto Liability fund.

RECOMMENDED ACTION: Approve the settlement.

No, Munroe Regional will not transfer any of the accounts receivables to the new Marion County EMS Alliance corporation.

 

Both hospitals will however jointly contribute equipment, vehicles and supplies currently used in the ambulance service operation.

 

In addition, each hospital will contribute about 25% of the annual budget short fall up to $1,675,000/year.
